HGV Driver Accused of People Smuggling Acquitted of All Charges After Crown Court Trial
Simon Clarke secured the acquittal of the driver of the truck which delivered a container holding 35 illegal immigrants, one of whom had died, to Zeebrugge port and later discovered at Tilbury. His case had been that his employer had duped him into doing the run without any knowledge of the immigrants in the container. His employer was later convicted of being involved in that crime.
In September of this year the same driver, again represented by Simon Clarke, faced a trial for the theft of a container holding a valuable cargo of copper wire. Again his employer, who had earlier admitted the charge, duped our client and again our client was acquitted of the charge, this time after hearing legal argument from Simon Clarke, who argued that it would be an affront to the justice system and therefore wrong to try him at all. The Judge agreed with Simon and ordered the charge to be dismissed.
