SBC Represent Ten Drivers at Driver Conduct Hearing – All Dealt with Below Recommended Starting Point.

SBC were approached to represent ten drivers from the same company who were to be dealt with at a Driver Conduct Hearing for assorted tachograph breaches including card pulling. Barristers Helen Newbold and Millicent Dooher represented the drivers, many of whom were looking at long suspensions or revocation of their licences owing to repeated instances of creating fraudulent records (card pulling.) The Senior Traffic Commissioner’s Statutory Guidelines Document No 6  recommends for card pulling; “4 week suspension per offence up to 6 offences & revoke and disqualify for 12 months for more than 6 offences.” 

All of the drivers did better than this starting point – the longest disqualification was for 12 months for a driver with 24 infringements (a man lucky to escape prosecution and sentence in the Crown Court!)
