Restricted Licence Allowed to Continue after Public Inquiry Despite Regulatory Failings

The Operator in this case, represented at Public Inquiry by barrister Harry Bowyer, had a disastrous TEOR where it was discovered that he had not been keeping to the scheduled maintenance inspection period, had not been analysing his drivers’ hours, had MOT failures (and a prohibition issued at the DVSA visit). The drivers’ daily defect inspections were clearly inadequately performed and there was no system of gate checks.

SBC advised as to the steps to overhaul the operator’s systems, such as they were. The Operator attended an Operator Licence Awareness Course.

At Public Inquiry the licence was allowed to continue subject to a short curtailment
