Operator Keeps Restricted Licence following Disc-Lending Concerns

 

This HGV operator had been called to a Traffic Commissioner’s Public Inquiry. The DVSA had discovered one of the operator’s licence discs in the cab of a vehicle belonging to a completely unrelated business and the Traffic Commissioner was after an explanation.

 

The operator was able to give evidence to the Traffic Commissioner’s satisfaction that the licence disc had been used by the unrelated business without the operator’s knowledge. Evidence was given that the crime had in fact been committed by a rogue employee of the company who had since been dismissed.

 

Another problem faced by the operator was lack of financial standing. After hearing all the evidence submissions on behalf of the operator, the Traffic Commissioner allowed a temporary curtailment of the licence until such time as financial standing had improved. It was accepted by the Traffic Commissioner that the operator had not been complicit in any licence lending.
