Licence Retained After “Compliance Fell off a Cliff.”

This Operator was called into his second Public Inquiry in 5 years. He was represented by Harry Bowyer at both Public Inquiries. After surviving the first Public inquiry the Operator, who had a restricted licence, was under the care of a first rate transport consultant who oversaw the transport team until they were fully capable of running the transport side of the business by themselves. The Transport Consultant became surplus to requirements and left them to it. Unfortunately the operator was hit by a perfect storm of incidents which meant that the transport team did not receive the attention that it should have and the transport team were hit by a number of personal issues including illness and bereavement.

The Transport Consultant was called in after it was realised that things had gone awry and discovered that, as he told the Traffic Commissioner and was perfectly evident from the documentation that “compliance had fallen off a cliff.”

After hearing evidence from the operator and the consultant as to the steps that had been taken to turn the business around the Traffic Commissioner allowed the licence to continue after a short suspension.
