Licence Granted As Applied for Despite Concerns about Fronting

This applicant, represented by barrister Harry Bowyer, was the wife of a director of a family firm that had gone crashing into liquidation with massive debts. She had seen that a portion of the business was still extremely profitable and bought some of the assets from the Administrator.  She answered “N0” to the question in the application form as to whether she had bought assets or shares from another company. She thought had not as she had bought them from the administrator. That misdeclaration as well as the similarities in operating centres and personnel aroused suspicions that she was fronting for her husband. When the Traffic Commissioner met the applicant and her Transport Manager it became quite clear that this was entirely her own operation without any involvement of her husband and the licence was granted as applied for.
