Former Transport Manager Unable to Demonstrate Continuous and Effective Control Retains Full Repute

Barrister, Helen Newbold, represented this former transport manager when the Operator was called to a Public Inquiry for licence lending, not complying with undertakings on his operators’ licence, significant missing mileage, and a paucity of information in both driver and vehicle files.

A DVSA investigation identified a significant amount of issues with the operation of this standard national licence, most of which the transport manager was unaware of. Taking the former transport manager through the DVSA traffic examiners report and addressing each issue Helen Newbold was able to demonstrate to the Traffic Commissioners satisfaction that the former transport manager had been unable to perform his role as required due to the lack of cooperation and communication from the operator himself.

The Traffic Commissioner stated that he would have expected the transport manager to have acted at an earlier stage and in that respect, he issued a formal warning. However, this result ensured that the transport manager was able to continue with his new employer with his reputation untarnished.
