Double Trouble – Driver Faces Magistrates and Traffic Commissioner in the Same Week

This driver, represented by Harry Bowyer, was caught by the DVSA pulling his tachograph card on 5 occasions. He was prosecuted and was at real risk of being committed to the Crown Court and a custodial sentence.

In mitigation he was able to show through text messages that he had been placed under direct pressure by the Operator to pull his card.

The District Judge accepted that the driver was placed under direct pressure to pull his card and dealt with the matter by way of financial penalties.

Two days later the driver appeared in front of the Traffic Commissioner for these matters. The Traffic Commissioner was also persuaded that there was pressure put on the driver to pull his card and significantly reduced the suspension that he would otherwise have imposed.
