Card Pulling Driver Escapes with £215 fine.

This driver, represented by barrister Millicent Dooher, accepted removing his tachograph card whilst driving. He had driven for almost 8 hours without a qualifying break. The DVSA referred this to the Courts, where Millicent was able to persuade the Magistrates’ that they were the correct Court to deal with the offence and to impose only a low level fine.

Driving without a tachograph card is creating a false record, this is seen as an offence of fraud. This can be heard at either the Magistrates Court or Crown Court. If the hearing is sent to the Crown Court, the offence can carry a custodial sentence of up to 2 years.
